What a freakin’ mess.
Suspended Jameis Winston is being sued by the former Uber driver in Arizona who claims America’s Quarterback touched her crotch without permission back in March 2016.
You know the story, and now her full side of the story is public in a civil suit filed in Arizona (link here). You can read it all in that link. There’s nothing much that is new.
Brutal timing for Jameis, and for Bucs fans, and for Team Glazer.
Will Jameis make this go away? Because that’s what civil suits are all about.

Question, originally, did she not claim he felt her up in the drive thru?
If so, the lawyer said she googled his name while he was in the restaurant getting his order. She also claimed she did not know who he was until later, and yet the lawyers statement contradicts that.
To me, this proves she is a liar. Problem is, the NFL stripped Winston of the right to face his accuser in court by threatening to ban him in the suspension statement.

It certainly does feel like a cash grab from a woman who originally said she wasn’t interested in collecting damages. She (or her legal) let the NFL do the leg work and issue the statement that they came to conclusion he acted in an inappropriate manner and ammunition in her case. THEN, when it would have made sense to immediately turnaround and try to collect damages, she waits until the statute of limitations expires which coincidentally is 1 week before he was scheduled to return to the team. She’s using every last bit of leverage she can to squeeze some money out of him.
My suggestion to Jameis’ legal team, is to make a public offer to pay for any treatment to date, plus 1 more year’s worth (subject to her attending, his team receiving the bill, and the charges not to exceed 120% of 12 months of previous charges) AND offer 75K to a women’s crisis center/charity of Kate’s choice. I think that would show Jameis is taking this seriously, and showing sympathy for the situation he said he put her in.
If this were offered, I don’t think she would take it, as it doesn’t increase her own account balance.

I’m a woman defender and i saw this coming when this all became public so not a surprise but the timing is, I thought she was waiting for his big payday that he may not get now.
It is what it is and regardless at some point you just have to stop defending bad judgement and he had to live with the consequences. Doesn’t matter whether he did it or not or whether she is a gold digger, a quarterback cannot be in these situations then call himself the leader of a team. If he has to sit the bench it’s his fault, if doesn’t get his 20 mil it’s his fault. He ruined his own image and if he plays like a hall of famer the rest of his career he will still be branded for this

Whether it’s a money grab is irrelevant. The problem is they can and will use the findings of the NFL investigation to bolster their case and up the settlement figure. If JW doesn’t settle then the discovery process could reveal more salacious and embarrassing information. A good lawyer would know that even before filing suit. JW has put himself and the Bucs organization in a tough spot and a constant drip of bad PR. Let’s not forget JW is a whisker away from being banned from the NFL in the event of another misstep. And yet the Bucs are betting the house on this guy. Unbelievable!

Shocking, the pig never reports anything to any authority, where filing a false claim and result in you going to jail, she lets that time period go buy, and now sues in a civil court where people file fake claims all the time knowing that she’ll just get a payoff, or at worst for her, in a civil court, where there’s very little burden of proof of guilt, she can just cry and will get millions of dollars given to her even though it’s nothing but he said/she said. So let’s deflect and refer to some other possible accusations nationally? What does that matter here? Why is that Winston is always “the guy” that some woman is falsely accusing him of sexual misconduct? Nothing ever from other young Qb’s like Watson, Mahomes, Darnold, Jackson, Mayfield, etc. for example.
He’s already been suspended for this. The NFL cannot again, it’s called Double Jeopardy. The only thing this will now effect is his wallet again.

Considering Kate hired the cleatchaser’s lawyer – was there ever any doubt this was always about maximum embarrassment and some money considering she didn’t feel “violated” enough initially to involve law enforcement at a time when an actual and relevant investigation to uncover the facts could have taken place?
Just think of how the news of this “incident” ever even came to public light in the 1st place… TMZ style! A #metoo minor groping accusation (hand brush of privates over clothes) on buzzfeed of all places – without a shred of evidence to back it up (which is exactly why LEOs were not involved in the 1st place).

The money ay FSU basically was paid to the same lawyer…the accuser gets some. I can write this set up. The accuser contacts her boyfriend ” The woman did not file a report with police but had discussed it with her boyfriend. She did report the incident to Uber the next day. Uber contacted Winston, who told the ride-share service that there were other passengers in the vehicle that night.”
So simple called boyfriend told him a completely inebriated football player (JW) was just put in my car…ching ching…
After making the plan reported to her job the next day! Then found Clune (the other accuser’s lawyer)with the help of the NFL don’t prosecute…because it was going to be pay day after the suspension. BOOM!
Because Jameis will need to make it go away…he hasn’t played or payed for 3 weeks

I don’t want to bore you guys, but in a civil case the legal standard is a preponderance of the evidence, not beyond a reasonable doubt as in a criminal case. With that lower civil law standard, she might win the case. If I were Jameis, I think I’d likely settle and get it all over with.

So the Uber driver probably thought reporting it to her employer was enough. She may have thought that Uber would report to law enforcement if warranted. Kalind – it is civil court, there is very little burden of proof – it’s simple reasonable doubt. So the woman goes up and testifies and starts crying and she wins automatically – that’s how the system works in civil court. There’s a reason authorities were never involved, because filing fake police reports get you in a lot of trouble. Everyone knows this never goes to trial, this will be settled out of court since Jameis can’t risk millions at a trial when literally all she has to do is tear up and she wins.
During WW2 the US Army put rapists to death, and that’s what should happen to real rapists, and that’s why claims of rape and sexual assault are big deals, and it’s why women who lie, who yell rape to get an easy payday, those women should face the same punishment as those they accused would have been faced when it’s proven they were lying.
In any case I don’t believe this woman for a min – she’s just another #MeToo slob looking for handout.

I don’t think any true Buc fan wanted this to turn out like it has, whether you like Jameis or not. We wanted him to be a superstar. Whether or not he is, or ever was, is highly debatable.
Having said that, No it wouldn’t be all that surprising, and that’s a damn shame.

Shoulda seen this coming when she hired that lawyer the gold digger Kinsman had. Now it makes sense why she did it and waited until now. If she never filed criminal charges she shouldn’t be able to file civil lawsuit, if she had then no problem. I feel bad for Jameis because it’s all piling on him higher and higher but I don’t feel sorry for him because he put this on himself, and unfortunately for him this might be the public opinion straw that breaks the Glazers patient backs. Plus Fitzy playing lights out isn’t helping his cause either. Oh well too bad so sad. Be happy haters your public hatred might be rewarded soon.

Winston’s best option in re the lawsuit is to counter sue for his lost income due to her malicious and false accusation
Said lawsuit should name her lawyer (who obviously sought her out) as co-defendant, he’s got deeper pockets than her anyways
Her lawyer would have her settle for $20 cash (the going rate, right Kobe?) in a heartbeat

“Kate” isn’t seeking 75k. That’s the figure that court sets to determine if the suit is above or below that threshold. In this case, the suit seeks damages in excess of 75k without limits .
If your beliefs about the nature of case rests upon the victim seeking only 75k then it’s time for a rethink. This suit specifically asked the court to impose no limitations on the total amount the plaintiff is seeking for relief.
This is a million to multi million dollar’s action. They , the plaintiffs legal representation, is looking for more than 75k. Much more. The thing to consider is that the same legal team representing kate, has already found a dollar figure as a floor to begin this suit. Based on how much winston paid to the last victim . For those of you who don’t know, Winston settled the prIor civil suit with a non disclosed amount . That amount is at the moment the floor for the next series of negotiations to come.

Let’s see, the NFL investigated this for what seems like forever and found enough credible circumstance to suspend Jameis for three games…..so it won’t be hard to win a civil suit…..

He’s a bum. He was a bum in college and he’s a bum now. You are the franchise QB for an NFL team. How do you put yourself in a position where you need a ride from an Uber driver leaving late from a bar/club?
