One Buc Palace Not Moved By Suit Vs. Winston

Yesterday, the legal version of tax day came, the civil lawsuit against Jameis Winston by the same woman from the same alleged incident that Winston has been cleared of by four investigations and hearings.
Anyone who didn’t see this coming literally had his head in the sand or was living under a rock for the past two years.
The Bucs, who have done far more investigation into the background of Winston than Joe, or you, or the drunk in the bar, are unmoved by the civil suit, Twittered Woody Cummings of the The Tampa Tribune.
Bucs officials say civil lawsuit filed against FSU QB Jameis Winston today will have no effect on their draft plans.

Remember that Bucs co-chairman Joel Glazer told Joe at the NFL owners meetings he was comfortable with Winston playing for Tampa Bay.
Again, Team Glazer has the background investigation report on Winston, and met with Winston. Clearly, the Bucs expected the civil suit; the team of lawyers representing the woman all but promised it was coming. The only question was, when?
It sure smells like the timing was an effort to sabotage Winston’s chances of being drafted No. 1 overall. Joe would think the legal team representing the woman would want Winston to be drafted as high as possible so he earns as much cash as possible — more to grab if she finds a friendly jury.
Joe is still waiting for the moral outrage directed at Titans quarterback Zach Mettenberger, who actually plead guilty to sexual assault before he was drafted last year.

Depending on how ugly this gets, the Bucs have never announced their intentions, they could be planning to draft Winston, ownership and the NFL front office get spooked by the media, the Bucs switch to Mariota and say this didn’t impact their plans, because this is where they were going all along.

I don’t think this is a done deal by any means. Events happen, political winds change, and corporations will react to those events in a way they feel are in their best interests. I suspect over at OBP there have been meetings to discuss the impact. Had her legal team waited until after the draft, the impact would have been much less.

The problem with this suit is that it’s obvious the accuser isn’t going away…..she will absolutely testify and may have some evidence we don’t know about. I doubt Winston will settle the case, so it’s going to trial.
Some of the evidence could be really ugly and even in a “he said, she said” case….many will believe the accuser even if she didn’t win.
Bucs and Buc fans will constantly have to defend Winston to the general public and to many of their own fans….it is a PR nightmare at the very least.
The still may draft Winston…but the risks are huge.
He will have to live the life of a monk in order to avoid future accusations.

He had never played a game for FSU, Manuel was the starting QB. Yet the members of the police department and the University were so corrupt that they all covered it up for a young man who may someday earn the starting job. Does that even make any sense? Then the next year after he was starting and winning the State Attorney got involved, and he was corrupt as well or was he just incompetant? Then the retired supreme court judge, also corrupt? Wow, that is quite the chain of incompetance and corruption. All those careers at stake all for 19-20 year old Jameis Winston. Man that kid has some power!

After a bit of time passes and the law suit plays out, noise will die down. But just as people still bring up the Big Ben issue, this will never go away. The Bucs will have to be pretty sold on him to draft him because that is the baggage that comes with it. But that has always been the case.

Sometimes it is the only form of justice left open to victims. Few here are considering that, despite the lack of evidence, she may be an actual victim of rape.
As to the timing, it is bad timing…for her. Consider this, by filing BEFORE the draft, she effects Winston’s draft stock. What if the Bucs decide not to take him? What if he slides down to the second round or later (I know it probably will not happen, but she can’t know that for sure)?
It would mean he would have less money, and she would have less ability to collect in a lawsuit.
So really, filing early potentially get’s her less.
However, if she was ACTUALLY RAPED and cares less about money and more about payback, then hurting Winston’s stock gains her a small measure of justice.
Unless you are a victim who cannot prove the truth, you cannot understand it, I suppose.
I’m not sure I believe her at this point, but maybe that’s why she’s doing this. Because no one, not the media, the judge, the school or anyone, has believed she was actually raped. If she was raped, not being believed can be worse than the rape itself.
That no one here can grasp this is disturbing.
Personally, I figured a lawsuit was coming, and it doesn’t change my opinion on Jameis. I still prefer Mariota, but will accept Jameis. If he is guilty though, I hope he hurts bad for it. Because if it was my daughter he raped and there was no legal justice? I would kill him.
BUT…if he is innocent? Then he is the victim here. I allow for that possibility. I also allow for the possibility that if he is guilty, he may never do anything like it again. Or, he might do it again. It could go either way, after all, if he did rape her, he got away with it.
And maybe, just maybe, the victim actually wants any form of justice she can get because so many people helped him get away with it. If he did it.

The Bucs most likely invested more time and resources investigating Winston than any other draft pick in their history. They’ve known about the potential civil suit all along. If they decided Winston is worth taking with first pick, they’ve also decided that any fallout from the previous allegations is worth dealing with as well. NFL teams don’t like distractions, but the Bucs must be confident enough that any distractions wouldn’t be significant enough to pass on Winston. This is assuming the Bucs draft Winston. The Glazers could get cold feet at the last minute and veto the pick.

I suppose anyone can sue anyone over just about anything, but it doesn not mean some of those cases even get heard. If I’m Winston’s lawyer, I would state early and often the lack of evidence for it to be even tried in court. On top of that I’d start a counter suit right here and now. Just see how far this gold digger wants to take this thing…

OJ Simpson is a great example of someone possibly getting away with a crime because of his popularity. Upon review of the court records, in hindsight, many attorney’s have said that the evidence presented to clear him could have easily been disputed, and that the prosecutor and judge failed to execute their duty properly.
To this day, none of us actually know if he was guilty. If he was, he got away with it…at least until justice was served in civil matters.
Consider this though…if you could go back in time and see that OJ was guilty, would you feel he deserved being ruined financially? Probably so.
As I have said, sometimes civil court is the only form of justice.

Each one of them. I suspect Erica had buyers remorse the next day, encountered her friend during her walk of shame back to her room, Her friend knows she has a boyfriend so Erica was embarrased and started making things up like the “I was drugged and hit on the head” that was reported to the police but proved not to be true. Once her aggressive “our kid would never sleep with a black boy” family became involved there was no turning back. At this point I think she even believes her own story.

Maybe her legal team will bring some hard evidence against Jameis that the Tallahassee PD conveniently forgot to leave out of their report. We all know that department isn’t very forthcoming with information regarding FSU athletes’s legal issues. Nobody knows how this thing is gonna shake out, Bucs brass included. I realize there are very differing opinions of Winston and the rape allegations. Mine is that, he was not found guilty of any criminal offenses and these young ladies (and I use the term loosly), are gold digging opportunists who obviously were intelligent enough to realize who Winston was and that he had a lot of money in his near future. Since there is no shortage of females who operate in this capacity, I would suggest to Jameis that he avoid women like the plague and find a nice girl probably a long time acuaintance from his youth and settle down by getting married. Playing the field will ruin him because now that he has been targeted, there are skanks here in Tampa, as one of the ones involved now is, who will line up to throw what they have at him and then get in the I was raped line. There is no way Winston should file a counter suit….all that would do would be to attract more attention to a $hit-storm they want to go away.
This will ebb in time if Winston becomes a productive player in the NFL…..Winston will likely win the civil suit….but that’s not a certainty. We just don’t know all of the evidence and can’t get into the mind of jurors.
This is simply a PR management issue from this point on and thus far Winston’s team has done a good job of it…as have the Bucs.
As long as Winston doesn’t repeat acts like yelling “FHRITP”…..he’ll likely survive the issue.
Opposing fans will be brutal…..be prepared to defend him indefinately!!!

Also As I understand it, Winston never denied engaging in sexual intercourse which DNA evidence would prove anyways and there are signs of forced sex which the investigators could and would have easily found as evidence to support any claims of rape. I think what it all boils down to is that if you are a high profile individual with a promising carreer and much money in your future, just avoid giving the opportunists any opportunity.

Just look at the writing on the wall. It is a fact that Winston scores that night, only consensuality is in question, and that’s not easy to question considering the lack of evidence, her hang in out with Winston prior, and her obvious interest in the big man on campus.
At this point, you either feel sorry for her because nobody believe her and if it did happen, it’s horrible. Or you despise her using her gender to take advantage of a millionaire-to-be and is only looking for a paycheck.
Considering she is after all this money, rather than just trying to prove it happened, this doesn’t favor her at all.
None of us were there that night, nobody can simply say “IT DIDN’T HAPPEN” like they say “Winston IS the pick”. For all we know, she and her attorneys have done a terrible job of presenting this with a lack of evidence.
But I wouldn’t bet on it. I am Pro-Mariota, but even I don’t think he is a rapist.

Went to a party when I was young teenager about Jameis’s age, the party was in a hotel, the bathtub was filled with a nice fruity grain alcohol mixture. There was a lot of drinking going on. As soon as I walked through the door, this blonde cutie grabs me and sticks her tounge down my throat, she then proceeds to bounce over to the next guy, and then the next. I was a smart young man and realized as crazy as that party was getting, leaving would be a good idea. When I left, that same girl was lying on a bed making out with two guys. The next day all the buzz was that she had gone to the police because she had been raped. Thank god I left! With our goofy legal system, she may have leagally been raped as she was clearly drunk and not in a mindset to say no, but when I left, she was the sexual aggressor. Maybe Jameis is guilty as charged (or not charged), but I would sure like to see it proven before he is declared guilty by a mob mentality and public opinon.

The local DA, State DA and Former State Supreme Court Justice all conducted separate investigations, any one of which could have levied charges or sanctions. This is exactly what should happen if you are accused of a crime you didn’t commit. Too many people watch too many movies and think the criminal justice system only operates in a court room with a 12 person jury. Majority of all legal issues are settled or determined outside of a court room.

The COC hearing was her absolute best chance. and she lost.
The civil case has the same 50% threshold but, this time, she is open to being deposed by opposing counsel.
There is 0% chance her attorney will allow opposing counsel to depose her and to enter exhibits into evidence. This is about fishing for a settlement, and just trying to throw mud on Winston right before the draft.

lawsuits don’t scare me, a ton of interceptions because of not reconizing underneath coverages does. He’s inaccurate at times and forces things. Its like he was smart to do all this stuff off the field because everyone is just looking at the off the field mistakes. He does have some freeman in him… big ,strong, sloppy mechanics at times. he really missed k benjamen, who was tall and hard to over throw. These are all facts…who am I prone to believe here? If she was really raped, then she deserves an award or something for her performance in destroying her own case.

She lied about being drugged. 2 separate toxicology reports showed no traces of drugs or alcohol in her system. In the documentary she claims she was drugged, however in the FSU proceedings she never once made this claim.

How long after the event was the toxicology report done? Even that doesn’t prove she lied. In an attempt to explain her disorientation she comes to the conclusion that she was drugged. Even if this is not true, that doesn’t make her a liar. She never claimed to see the drug put in her drink. Also she could have been drugged and also had a clean tox. They do not screen for every drug possible, just the most common.

1.First the perp was 5’9
2. Said first said a short guy with dreads gave her a shot
3. Then she said instead, a white guy gave her a shot

6. Then she said she was drugged – detox was tested for 127 (or some similar number) types of drugs at FDLE and then at the UF Chem lab
7. She said she felt coerced to leave the Bar with Jameis and teammates. But, her own friend testified she asked her if it was ok to leave with them, and then left.
8. At the COC hearing she denied the she claimed being drugged.
9. In the documentary, she reversed again and claimed being drugged.
She also deleted all social media (#cleatchasers) right after that night.
Her first text after is happened was asking for test questions for a class.
She never called police or parents. Her friends did.

I honestly feel she is being coerced by her Aunt lawyer, and the Colorado Title IX attorneys. She let the initial claim go totally dormant from March 2013 until the exact day (Nov. 2013) after Oregon lost and Winston became the Hei$man favorite. The timing was not coincidental. When he became valuable, the claims started again. She never even called police or her parents initially. I don’t think she expected this to happen, and now it’s gotten away from her.

We don’t have moral outrage about Mettenberger because he’s not a candidate to be drafted with the first overall pick. Actually, it’s not about moral outrage, or morality at all. It’s about feeling confident that the guy you’re making a huge investment in isn’t going to make you regret the decision by effing up. Winston seems to have cleared the confidence hurdle.

Seems to me that they filed suit now, two weeks before the draft, in hopes that Winston would be more likely to settle. Basically, they’re trying to use the draft the put pressure on Winston and his lawyer’s to settle now so his draft status won’t be effected. That’s a cash grab move to me, not someone that’s trying to fight for justice.
