ASJ Conviction = 10 Days In Jail, 5-Year License Loss

GavelYes, Austin Seferian-Jenkins was arrested for an ugly-sounding DUI this morning in Tampa.

But now what?

Joe turned to prominent Tampa defense attorney Brett Metcalf (HillsboroughDefense.com) for answers.

A former prosecutor at the State Attorney’s Office in Tampa, Metcalf said of Seferian-Jenkins, “based on his prior DUI in 2013, ASJ will have to serve 10 days in jail and his license will be suspended for five years if he’s convicted this time around.”

ASJ plead guilty to DUI in Washington back in 2013. That incident involved a crash.

Once upon a time, the Bucs had another troubled Washington tight end, Jerramy Stevens, who loss his license because of driving arrests. Former Bucs QB Jeff Garcia used to drive Stevens to practice.

    Remove him from the team! Get him treatment immediately!

    Suspend him until at least the bye. Then have a consultation with his head doctor to see if he can actually stand the stress of playing yet. He may need an entire year to get better.

    I realize we are all peoed at this and justifiably so. But if he had just been diagnosed with cancer would you be piling on? Do you disagree with experts who claim alcoholism is a disease?

    If he can’t beat the disease then he can’t play..simple as that.

    I am not a Nole nor Gator. But that was a bit of a cheap shot from my perspective.

    If it had happened in Gainesville…Tuscaloosa…Clemson…Columbus…virtually any college town he would have had a better shot at skating.

    Bottom line while I agree with your point and consider it accurate perhaps it could have been better stated as any medium sized college market.

    I’m not sure why in the world people keep saying for the team to get him treatment. They’ve set up opportunities for him to avoid these issues at every turn and he’s chosen to bypass those safeguards. The onus is on him and his family to get him help, if he needs it. Not really even on his family, but it’s on them more than it’s on the team. He put them in a bad spot by not having him for the game and taking their attention away from the game to deal with his nonsense. They owe him nothing. Put him out on the curb and tell him the stuff from his locker will be mailed to him. Give him a firm handshake and a good luck, then take his access card and send him out in to the world. What he does from there is on him.

    What’s weird is ASJ is a pretty good speaker and comes off as intelligent. But he has that sketchy vibe where you never know what might be real or fake

    Valid points but I think the team should get him treatment even if you do not agree on the human level. Yeah his family should have had an intervention…have you had an alcoholic in your family?

    My inlaws did..they even finally did the intervention and it failed. My late BIL died in the hospital with a liver that no longer functioned.

    Perhaps his family doesn’t have the leverage. The team DOES have leverage.

    I do not know if ASJ is an alcoholic. Could simply be undisciplined. But if he IS an alcoholic I’m not for simply judging him as a loser. Again if he had cancer would you toss him into the dump or perhaps you do not believe alcoholism is a disease?

    If he is an alcoholic the ONLY chance this franchise has at saving a high draft pick is with treatment.

    I know there is a school of thought that says toss him to send a message to the team. I get that and respect the point of view but you can send just as strong of a message with a suspension and treatment. You actually send TWO messages that way. First we’re not going to tolerate this type of behavior…backed up by two…you’re not just a piece of meat to us and we care about our players. If you are a Buc we’ll do our best to help but there are limits.

    Ok couple questions. What did he blow? It matters, if he had 2 drinks with friends and was just over the limit as a team I can let that slide. People get DUIs all the time, have a good friend who is an ADA had a DUI. My issue is if he was out getting totally smashed a couple days before a game. I get it, it’s a history of bad decisions with this guy, but when I was his age I drive home drink every day that ends with “y”. Then again I want being paid millions of dollars. I’m just saying, was he in a wreck with injuries? He didn’t beat up his girl, wave a gun, stab someone, or have a body in the trunk. Sounds like a run of the mill DUI. If everyone who got a DUI list their jobs half the population would be out of work. Let it go. The team will handle it how they feel best. It’s not like he stole some crab legs.

    destro – It’s not his first and he was supposed to have an anti-starter on his ignition for a previous DUI. He’s in a world of crap right now. Multiple DUI’s and bypassing your breath alcohol ignition interlock device on your car. Dude is toast.

    I’ve got nothing for love for Jabo, I also made reference to Ray Rice, Ray Lewis, Ray Carruth wow that’s a lot of “Rays”. My point is yes he has legal issues, but I don’t see the league or team coming down hard on this, but who knows there team may wash their hard of him. He is a young dude with ample cash, driving drunk is foolish, but I’m betting most of us have done it. Should I have finished with “it’s not like he got caught soliciting a BJ on the eve of the Superbowl”

    First, It blows my mind when a professional athlete gets a DUI. You mean to tell me there isn’t one freeloader that hangs around this guy, that wont stay sober and drive?

    On another topic, there is no run of the mill DUI. Every single one has a very high potential of ending in tragedy. Tragedy happens in the world, on its own, every day. No need to be a selfish idiot, get behind the wheel impaired and raise the probability.

    Qualifying ASJ’s arrest based on the BAL is hogwash. Sure, I understand alcohol impacts people differently- ASJ is a big dude- but the minimum threshold is intended to protect people, “run of the mill” or not. At its core, this is about ASJ the fool who allegedly got behind the wheel of a car with no consideration for anyone else in his proximity. Beyond that, as a professional athlete, in season, its hard to justify being out at that hour. This guys lack of self-awareness is beyond concerning. He apparently has no compunction about hurting himself and others.

    @SPBF – I appreciate and respect your stance on the matter. It seems like you’re well informed and your first hand experience certainly carries a certain amount of sway. That said, I’ll double down on my take that the team has no role to play in any of this. If the player did not afford the team the level of respect necessary to perform the function that they are paying him incredibly handsomely for, why does the team then owe him further consideration and extra time spent bending over backward for him. I am in no place to determine the validity of alcoholism as a disease or a disposition or whatever else it might be. I don’t have experience with it, so I am the furthest person from making that call. What I am saying is that this person wants to be adulated like a professional and paid like a professional but does not want to behave like a professional or work like a professional. At a certain point, a person is responsible for their own actions. I believe that ASJ had a responsibility to his team and he has shown over and over that he is willing to subvert that responsibility to his own desires. If there’s no reciprocity then it’s a parasitic relationship and it’s time for the team to make a clean severance of the ties.

    Destro, way off base dude. Just because he was very lucky that no one got hurt is no excuse. He was so out of it, he cut off a cop while going way over the speed limit. I know we often don’t punish violators who are just lucky, but I totally disagree with that policy. Sounds like he was being very dangerous to others. Get him off the road. And as far as the team, it was 4:00 am, on a work day – 2 mornings before the home opener. No excuses. No soft, easy passes. If he’s sick, get him help. But, no excuses like no one was hurt.

    He wont do ten days and he will have his license much sooner than that. Money and an attorney get you out of dui convictions like you accidentally stole a candy bar. Thats why they are still so common its about money not saftey.
